Who can use Kablam
Kablam is a service for teachers, teaching assistants, school staff and other adults who lead learning, such as home educators.
To create an account, you must be an adult (at least 18, or the age of majority where you live) and able to accept these terms.
Pupils don’t need an account and must not create one. They take part in games that you lead, on a screen that you control, and you are responsible for supervising them while they use Kablam.
If you use Kablam at school, make sure you follow your school’s rules. If you accept these terms on behalf of a school, you confirm that you are allowed to do so.
Your account
You sign in with a one-time code that we send to your email. Keep your email account secure: anyone who can read your email can sign in to Kablam as you.
Use an email address that you control and keep it up to date. Each account is for one person, so please don’t share yours.
You are responsible for what happens in your account. If you think someone else has used it, tell us straight away at hello@playkablam.com.
You can stop using Kablam at any time. To delete your account, email us.
Plans, payments and subscriptions
Kablam has a free plan and paid plans. What each plan includes, and what it costs, is shown in our pricing and at checkout. The features of the free plan may change.
Payment. Paid plans are paid in advance, monthly or yearly, in the currency shown at checkout. Prices include VAT or sales tax where we must charge it; any tax added at checkout is shown before you pay. Payments are processed by our payment provider, whose terms also apply to the payment.
Automatic renewal. Your subscription renews automatically at the end of each billing period, at the price in effect at that time, using your saved payment method, until you cancel. Before a yearly subscription renews, we send you a reminder.
How to cancel. You can cancel at any time from your account settings or by emailing us. Cancellation stops the next renewal, and you keep paid features until the end of the period you have already paid for. Unless the law requires otherwise, we don’t refund partial periods.
Free trials. If we offer a free trial, we tell you how long it lasts and what you will pay afterwards before it starts. Unless you cancel before the trial ends, your paid subscription starts automatically.
Price changes. We may change our prices. We will tell you at least 30 days in advance, and a new price applies only from your first renewal after that notice. If you don’t want to pay it, you can cancel before then.
Failed payments. If a payment fails, we may try again and pause paid features until it goes through. Your lessons stay in your account.
Right of withdrawal (EU and UK consumers). If you live in the European Union or the United Kingdom and buy as a consumer, you can withdraw from a new subscription within 14 days of purchase, without giving a reason, by writing to hello@playkablam.com. Because you ask us to start your subscription straight away, if you withdraw we refund what you paid minus an amount in proportion to the service you received before you told us.
Purchases for a whole school. These may be covered by a separate agreement or order, which takes priority over these terms where the two differ.
Your content
“Your content” means the lessons, questions, explanations, notes, pictures, materials and anything else you add to Kablam.
You keep all the rights you have in your content. You give us a worldwide, non-exclusive, royalty-free permission to host, store, copy, adapt (for example, to resize pictures or lay out lessons for the board), display and transmit it, only as far as needed to provide Kablam to you and to the people you share it with. This permission ends when your content is deleted, except for copies that others have already saved from a link you shared, and for backups kept for a limited time.
You are responsible for your content. You confirm that you have the right to use it (for example, that you may upload the textbook pages or pictures you choose) and that it doesn’t break the law or anyone else’s rights.
Don’t include personal data about pupils or anyone else in your content.
Sharing. When you create a link, anyone who has it can view and play that version of the game, and signed-in teachers can save their own copy, which they can then edit. Switching the link off stops new visits, but copies that teachers have already saved stay with them. Shared games can show the display name you choose.
We may remove content, or switch a link off, if we reasonably believe that it breaks these terms or the law, or that it puts children at risk.
Lessons drafted with AI
Kablam can draft lessons from your instructions and materials using artificial intelligence. A draft is a starting point: it can contain mistakes, inaccuracies or content that is not right for your class.
Review and edit every draft before you use it with pupils. You decide what to play, and you are responsible for the lessons you use.
Drafts are created only when you ask for them. The games themselves follow fixed, prebuilt rules: no AI is used while children are playing.
Drafts are part of your content, and we don’t claim ownership of them. Other teachers may receive similar drafts.
We may limit how many drafts you can create, for example to keep costs fair for everyone.
Rules for using Kablam
Please use Kablam in the spirit it was made for: helping a whole class learn together. In particular, you must not:
- upload or share content that is illegal, harmful, offensive, discriminatory, sexual, violent or otherwise unsuitable for children;
- upload pupils’ personal data, or use Kablam to collect information about children;
- upload material that you don’t have the right to use;
- try to access accounts, data or parts of Kablam that are not meant for you, or get around the limits of plans, sharing or AI drafting;
- harm the security or performance of Kablam, for example with malware, excessive automated requests or attempts to overload our servers;
- copy or extract the library, artwork or other content in bulk, or use them to train AI models;
- resell Kablam, sublicense it or offer it to others as a service without our written permission;
- use Kablam to mislead people, including by pretending to be someone else.
Kablam’s content
Kablam’s software, design, characters, artwork, sounds, game library and ready-made lessons belong to us or to the people who license them to us, and they are protected by intellectual property laws.
While you use Kablam, we give you a personal, non-exclusive and non-transferable permission to use them for teaching and learning: showing games to your class, projecting them on the board and printing the answer cards for use in class. You may share links to games. You may not otherwise copy, sell or redistribute them, create products derived from them, or remove ownership notices.
The Kablam name and logo are our trademarks. Please don’t use them in a way that suggests we endorse or work with you.
If you send us ideas or suggestions, we may use them freely, without any obligation to you.
Our lessons refer to school curricula, but Kablam is not affiliated with, or endorsed by, any ministry or education authority.
Using Kablam in class
You choose which games are right for your pupils, supervise them while they play and follow your school’s child-protection and technology rules. The ages and year groups we suggest are guidance only.
Changes to Kablam and availability
Kablam keeps evolving: we may add, change or remove features. Some features may be marked as pilot or preview features and may change more often.
We do our best to keep Kablam available, but we can’t promise that it will work without interruptions or errors. We may need to pause it for maintenance, for security reasons or for reasons beyond our control.
If a change significantly reduces a paid feature that you are paying for, we will tell you in advance. You can then cancel and receive a refund for the unused part of your billing period.
Suspension and closing an account
You can stop using Kablam and cancel your subscription at any time.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect pupils, other users or Kablam. When it is reasonable to do so, we warn you first, give you the chance to fix the problem and explain our decision.
If we close your account without any breach on your part (for example, because we stop offering Kablam), we give you at least 30 days’ notice where possible, time to export your lessons and a refund in proportion to any fees you have paid in advance.
When an account is closed, we delete its content as described in our Privacy Policy. Terms that by their nature should continue to apply (such as the permission for copies already shared, limits on liability and the governing law) remain in force.
What we promise, and what we can’t
Kablam is a teaching aid. We work hard to make our content accurate and suitable for each age, but we can’t guarantee that it is free of errors, complete, or right for every class or curriculum.
As far as the law allows, Kablam is provided “as is” and “as available”, without guarantees other than those set out in these terms.
If you are a consumer, you have legal rights that these terms don’t affect. For example, in the EU and the UK, digital content and services must match their description and be fit for their purpose.
Our liability
Nothing in these terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or intentional misconduct.
Subject to that, we are not responsible for losses that were not reasonably foreseeable, for the loss of data that you could have kept a copy of, or for business losses such as lost profits, revenue or opportunities.
Also subject to that, our total liability to you for all claims relating to Kablam in any 12-month period is limited to the greater of what you paid us in that period and 50 euros (or the equivalent in your currency).
Governing law and disputes
These terms are governed by Italian law. If you are a consumer, you also keep the mandatory protections of the law of the country where you live, and you can bring proceedings in the courts there. In all other cases, the courts of Italy have exclusive jurisdiction.
If something goes wrong, please contact us first: most problems can be solved quickly by email.
General
These terms, together with our Privacy Policy and whatever we show you at checkout, are the whole agreement between you and Kablam about the service.
If a court finds part of these terms invalid, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later.
You may not transfer your rights under these terms without our consent. We may transfer ours to whoever takes over Kablam, as long as your rights are not reduced.
These terms are available in English and Italian. If the two versions seem to say different things, the interpretation that is better for you applies.
Changes to these terms
We may update these terms, for example for new features or changes in the law. The date of the latest version is always shown at the top. If a change is significant, we tell signed-in teachers at least 30 days before it takes effect. If you don’t agree, you can stop using Kablam and cancel your subscription before then, and we refund the part you have already paid for the period after the change.
